This is questionable decision making on both parties involved. You see the dude trying to speed by you and cut you off and you gun it to not let him thru. Hopefully your LC is fixed up and no one got hurt.

The video shows he slowed down. MPH is right there on the video. OP didn’t gun it.
 
The truck ran into OP's lane so he is at fault but look at the semi losing the right lane going from 3 lanes to 2 and OP either didn't see that truck being a fool and not let the semi merge left or OP tried to beat it before realizing the need to take the heavy foot off the gas pedal.

Possibly I am not seeing it, but do not understand why the OP did not lean heavy on the brakes and attempt to back down from the situation.
 
I do not think there is any way to discern from this video what exactly is going on here. It would appear semi is changing lanes without seeing pickup and pickup moves into LC lane to avoid death. Now LC slows from 70 to 69 but we don't know how fast all this happened and if any of this could have been avoided. Was it realistic to be able to slow down more rapidly? No way to know and slow video makes it look easy. I am curious about the LC safety mechanisms - did it attempt to brake on its own? Was assisted drive mode engaged? Also, did the pickup stop eventually because it appears he keeps moving. Glad no one injured - this could have gone really bad.
 
Good point on the speed. Im loving this detective work bringing things into frame . The road definitely went from 3 lanes to 2.

Haha that’s a spicy take. That’s a 12 second video cut down from a 90 second clip, my speed was consistent (and documented on the video).

Other driver was found at fault and I had an “agreed value” policy, so I was covered for $79xxx, plus tax and license.

There was no shoulder so the semi and the Tacoma stopped up the road where there was a shoulder. The Taco driver told the State Patrol officer I was in the center lane and sped up and cut him off. She said the physical evidence supported his story over mine. The dealership installed a dashcam that refused to work with my iPhone, so I had to wait to get home to download the footage.

If you don’t have a dashcam, get one.

I understand what you are saying - you cannot tell from that video how fast this whole thing took place. That was my point and certainly not placing any blame!! Probably so fast that there was no way to react. Scary. The Taco guy may have really not known where you came from - you might have been in his blind spot. Who knows. All speculation. Just glad you are OK and also got compensated. Well I do. not know what an "agreed value" policy is, but sounds like it did not cover you entirely.

Yup. This is why juries are so untrustworthy even when you have a video.

IMO the truck could’ve prevented this accident. It seems to me from the video the semi had its left blinker on and the truck tried to beat it to the lane not realizing semi had nowhere to go.
 
Hope your doing okay OP and well on the road to healing yourself back to as normal as before the accident. So...will you get another LC?

Whatever else did or didn’t happen, you were situated in your lane, the Taco moved into your lane without noticing you there and hit you. That’s pretty much the story for at fault, I’d imagine.

I don’t think they go into chain events and what caused what person to do what upstream that led to what and eventually that chain of events caused an accident. It’s all God’s fault if you carry it upward far enough.

Agree on the dashcam. My daughter witnessed a bicyclist throw himself in front of a moving car in a roundabout in Vail last summer. Not sure whether the guy had a dashcam or what the cyclist’s calculus was on risk vs return, but the dashcam would have simplified the situation. Easy cheap proactive solution to a lot of problems.

I was getting excited for the new Pro 4Runner but they are 6-8 weeks out and I need a car, tired of driving POS Jeep rentals. You would laugh at the problems I’ve had with new Wagoneers.

Insurance says the “check is in the mail” and my loan hasn’t been paid off yet (I owe about 40%). This whole thing is such a pain in the ass. I can’t get the dealership I bought from to call me back about refunding my extended warranty.
 
I installed a dash cam because of this accident. I travel that exact same stretch of road once a month and know exactly where that is. I got the fitcam. It works great and cheap insurance for an expensive vehicle!

I have the black interior with premium package and the wheels are the optional 18 inch rims from the new Tacoma. The tires are just factory sized 256/70R18 AT4Ws.
 
It is always the person merging or changing lanes responsibility to merge safely, regardless of the OP’s speed. I can’t figure out why so many people can’t grasp this concept. A person driving in his lane does not have to slow down to let you in, you either speed up or slow down to merge, but you must do it safely. The pick-up should have slowed down when the semi started merging in front of him.
